Welcome to https://custom2wear.com (“Site”). These Terms and Conditions (“Terms”) govern your access to and use of our services, including placing orders for custom decorated apparel (“Products”). By using our Site, placing an order, or uploading artwork, you agree to be bound by these Terms.
2. Eligibility
You must be at least 18 years old (or 13–17 with parental permission) and able to form legally binding contracts. You confirm you’re authorized to place orders and comply with applicable laws.
3. Account & Security
If you create an account, you’re responsible for maintaining confidentiality and activity under your account. Notify us immediately of any unauthorized use.
4. Customer-Provided Artwork & Intellectual Property
4.1 Ownership & Responsibility
- By submitting any artwork, logos, or designs (“Customer Artwork”), you certify that you own the rights or have obtained licenses or permissions to use them.
- You agree Custom 2 Wear LLC takes no responsibility for verifying the ownership or rights of submitted artwork.
4.2 Indemnification & Liability
- You will indemnify and hold Custom 2 Wear LLC harmless against any claims, damages, or legal actions—including legal fees—arising from alleged or actual infringement.
- We reserve the right to refuse or cancel any order we believe may infringe on intellectual property or be offensive.
4.3 Upload Grievance
By uploading artwork, you agree to a statement at checkout:
“I confirm I have legal rights to use this artwork and will not hold Custom 2 Wear LLC liable for any intellectual property infringement.”
5. Orders & Acceptance
All orders are subject to our acceptance. You’ll receive an order confirmation but only when we send a shipping confirmation is the order accepted. We may refuse or cancel orders due to errors, unavailable inventory, or suspected infringement.
6. Prices & Payment
Prices include applicable taxes unless noted otherwise. Full payment is required before production. Payment processed securely via our third-party vendors. Custom 2 Wear LLC does not store credit card details.
7. Production & Shipping
Estimated production and shipping times are provided and may change due to bulk orders or shipping carrier delays. Risk of loss passes to the customer upon shipment.
8. Returns & Refunds
8.1 Custom Products
All sales are final on custom-decorated items unless there is damage, defect, or print error. Customers must report such issues within 7 days of delivery with photos.
8.2 Non-Custom Products
Unused, unwashed non-decorated items may be returned within 14 days of receipt, subject to inspection. A 15% restocking fee may apply.
8.3 Damaged Shipments
Report damaged shipments within 3 days of receipt with photos. We will replace or refund upon review.
8.4 Return Process
- Email support@custom2wear.com requesting a Return Authorization (RA).
- Ship your item(s) to our specified address with the RA noted.
- You are responsible for return shipping costs. We’ll process approved refunds within 7 business days.
9. Warranties & Disclaimers
9.1 Satisfaction Guarantee
We strive for high quality. However, we rely on your proof approval. We aren’t responsible for mistakes in spelling, punctuation, or design quality.
9.2 No Specific Warranty
OUR SERVICES AND PRODUCTS ARE PROVIDED “AS IS” WITHOUT WARRANTIES. TO THE FULLEST EXTENT PERMITTED BY LAW, CUSTOM 2 WEAR LLC EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
Except where restricted by law:
- We’ve included the clauses above so that only our actual liability is limited to order replacement or refund.
- We will be not liable for indirect, incidental, consequential, special, punitive, or lost profits arising from the use of our products or site.
11. Indemnification
You agree to defend, indemnify, and hold Custom 2 Wear LLC harmless from any third-party claims arising out of your use of the Site, Customer Artwork, or breach of these Terms.
12. Changes to Terms
We may update these Terms at any time. Changes take effect upon posting. Continued use after updates means you accept them—please review periodically. If you disagree, cease using our Site.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of Illinois, USA. You consent to exclusive jurisdiction and venue in Cook County, Illinois courts.
